These Terms of Service ("Terms") are a binding agreement between you and Neuroframe, Inc., a Delaware corporation ("Neuroframe," "we," "us," or "our"), and govern your access to and use of Filmback — our websites, applications, APIs, software, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" includes that entity.
1. The Services
Filmback is a platform for making films with AI. The Services may include: an AI-powered agent for screenwriting and production work; generation of video, image, voice, and music assets through AI models; version-controlled project hosting; review and collaboration tools; billing and administrative controls; and related APIs and applications. Some features may be offered on a free, paid, preview, alpha, beta, or early-access basis.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services unless authorized through an Organization. You may not use the Services if doing so violates applicable law.
3. Accounts
You agree to provide accurate account information, maintain the security of your credentials, and take responsibility for all activity under your account. Notify us at [email protected] if your account is compromised.
4. Organizations and Teams
If you use the Services through an Organization (including a team plan), that Organization may control your account and usage. Organization administrators may add or remove users, access, modify, export, or delete content, control permissions and billing, and view logs and activity. By using an Organization account, you acknowledge this control.
5. Content and Ownership
You may submit content to the Services — scripts, prompts, project files, reference materials, and similar ("Input") — and receive AI-generated content such as text, video, images, voice, and music ("Output"). You retain ownership of your Input, and you own the Output generated for you. To the extent any rights in Output belong to Neuroframe, they are assigned to you. If you are part of an Organization, the Organization may control content under its policies. You are responsible for your content and for ensuring you have the rights to use it.
6. AI Output Limitations
Due to the nature of AI, Output may not be unique, may be inaccurate or incomplete, and similar outputs may be generated for others. You are responsible for evaluating Output before relying on it or distributing it, including for compliance with laws and third-party rights (such as rights of publicity and likeness).
7. Acceptable Use
You may not:
- use the Services unlawfully or to violate intellectual property or other rights;
- generate content that is illegal, or that depicts real people without authority to do so;
- distribute malware or spam, or attempt to gain unauthorized access to systems;
- attempt to reverse engineer the Services or the models behind them;
- use the Services or their Output to build competing AI models;
- resell or redistribute the Services without our written permission;
- circumvent usage limits, metering, or billing;
- impersonate others or misrepresent AI-generated content as human-made where disclosure is required by law.
We may enforce additional policies.
8. Third-Party Model Providers
The Services route requests to third-party AI model and infrastructure providers to generate Output and operate the platform (see our subprocessor list). Neuroframe is not responsible for third-party services or their behavior, and your use of connected third-party services remains subject to their terms.
9. Fees and Billing
If you use paid Services:
- subscriptions renew automatically until canceled; cancellation takes effect at the end of the current billing period;
- usage past your plan's included allowance may bill on-demand, under limits you control, as it accrues;
- fees are non-refundable except where required by law;
- you are responsible for applicable taxes;
- we may change prices with notice — changes apply from your next billing period.
10. Beta Services
Preview, alpha, beta, and early-access features are provided "as is" with no guarantees, and may change or be discontinued at any time.
11. Suspension and Termination
We may suspend or terminate access if you violate these Terms, if required by law, if risk or harm is detected, or if payments are overdue. Organizations may also suspend their users. You may stop using the Services and delete your account at any time.
12. Disclaimer
THE SERVICES ARE PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, INCLUDING ACCURACY, RELIABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
13. Limitation of Liability
To the maximum extent permitted by law, Neuroframe is not liable for indirect or consequential damages. Our total liability is limited to the greater of the fees you paid in the last 12 months or $100 USD.
14. Indemnification
You agree to indemnify Neuroframe for claims arising from your content, your use of the Services, or your violation of these Terms.
15. Dispute Resolution
We will attempt to resolve disputes informally first. Failing that, disputes will be resolved by binding arbitration on an individual basis; you waive class action rights. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected].
16. Governing Law
These Terms are governed by the laws of Delaware.

18. Export Compliance
You must comply with all applicable export and sanctions laws.
19. Miscellaneous
These Terms are the full agreement between you and Neuroframe regarding the Services. If one provision is invalid, the others remain in effect. We may assign these Terms. We may update these Terms; continued use after changes take effect means acceptance.
